Terms of Use
Version 1.0 · Last updated · Effective
These Terms explain the agreement between you and Q25 LTD (trading as FamFusion) when you use FamFusion.
Today FamFusion is a public website of family stories and ideas. You can read and share it for personal use without an account. Accounts, Family spaces, uploads and paid services are not currently offered. Sections of these Terms that describe them apply only if and when we make them available, and we will tell you before they do.
Nothing in these Terms takes away your legal rights as a consumer. Ideas and activities on FamFusion are suggestions: please use your own judgement about what suits your family.
About these Terms
FamFusion is a trading name of Q25 LTD ("we", "us", "our"), a company registered in England and Wales with company number 12990025, whose registered office is 34 Dunelm Road, Trimdon, Trimdon Station, England, TS29 6PX. You can contact us at info@q25.co.uk.
These Terms apply to your use of the FamFusion website at famfusion.co.uk and any other FamFusion service that links to them (together, FamFusion). By using FamFusion you agree to them. If you do not agree, please do not use FamFusion.
Our Privacy Policy explains how we use personal information and our Cookie Policy explains the technologies we use on your device. They are not part of this contract, but please read them. If we offer a specific service, promotion or paid plan with its own additional terms, those terms will be shown to you before you sign up and will apply alongside these Terms.
These Terms are written in English, and the contract is concluded in English. We do not file a separate copy of these Terms for each user, but every version remains available in the version history on this page and you can save or print it at any time.
What FamFusion offers today
FamFusion currently provides free, public editorial content: articles in the Journal and information about FamFusion. It also has a private Admin area used only by our invited editorial team.
When we launch a new service we will explain what it does and what it costs (if anything) before you use it, and we will update these Terms, the Privacy Policy and the Cookie Policy where needed.
Your legal rights
If you are a consumer, you have legal rights that these Terms cannot take away, including under the Consumer Rights Act 2015. Nothing in these Terms affects those rights. For detailed advice about your rights, contact Citizens Advice (citizensadvice.org.uk) or, in Northern Ireland, Consumerline.
If any part of these Terms is read in a way that would exclude or limit a right you cannot lawfully give up, that part does not apply to that extent.
Who can use FamFusion
Anyone may read the public website. By accepting these Terms you confirm that you are 18 or over, or that you are using FamFusion with the involvement of a parent or carer. Parents and carers are responsible for deciding which FamFusion content and activities are suitable for the children in their care.
If and when we offer accounts or paid services, we may set eligibility requirements for them (for example, that the person creating a Family or buying a subscription is an adult who can enter a binding contract). We will set these out before you sign up. See also Children.
Using our content
The FamFusion name and logo, the design of the website, our articles, photographs, illustrations and other original content, and the software that runs FamFusion, are owned by us or used by us under licence. They are protected by copyright, trade mark and other intellectual property laws.
You may read, download, print and share FamFusion content for your own personal, non-commercial use, including sharing links to our pages and using an idea with your own family. When you share, please keep any credits and do not change the content in a way that is misleading.
Unless we agree in writing, you must not:
- republish, sell, license or otherwise commercially exploit our content, or present it as your own;
- copy substantial parts of our content onto another website, publication, product or service;
- use our name, logo or branding in a way that suggests we endorse or are connected with you;
- use automated tools to copy, scrape or extract content or data from FamFusion in bulk, including to create a database or to train or improve artificial intelligence or machine learning systems.
This does not restrict ordinary search engine indexing of our public pages or the use of accessibility tools and web browsers, and it does not prevent anything the law allows without permission, such as fair dealing for criticism, review, quotation or news reporting with sufficient acknowledgement, or private study.
Some content, such as photographs, research we cite or third-party trade marks, belongs to others. Their rights remain with them.
Ideas, activities and safety
FamFusion publishes stories, ideas, activities and suggestions for family life. They are general information and inspiration. They are not tailored to your family and are not professional advice.
- Every family is different. Please consider the ages, abilities, health, needs and circumstances of the people involved before trying an idea, and adapt or skip it as you see fit.
- Children need appropriate supervision. Where an activity involves children, a responsible adult should decide whether it is suitable and supervise as needed, especially with food, water, heat, tools, small objects, animals, travel or the outdoors.
- Physical and outdoor activities carry ordinary risks. Check conditions such as weather, tides, terrain, opening times and access before you go, and follow local rules and safety information.
- Professional advice. Our content does not replace advice from qualified professionals, such as doctors, health visitors, therapists, teachers, lawyers or financial advisers. If you have concerns about health, safety, wellbeing or a legal matter, please seek appropriate help.
We take reasonable care to make sure our content is accurate when published, but information can change. This section does not limit our responsibility for loss caused by our negligence; see Our responsibility to you.
Acceptable use
You must use FamFusion lawfully and respectfully. You must not use FamFusion to:
- break any law, or commit or encourage fraud or other crime;
- harm, exploit, groom or endanger children in any way, or share any content that sexualises children (which we will report to the authorities);
- harass, bully, threaten, abuse, intimidate or discriminate against anyone, or share hateful, violent, sexually explicit or otherwise harmful content;
- impersonate anyone or misrepresent your identity, age, relationship to a Family or authority to act for someone else;
- share other people's personal information, photographs or private family matters without the right to do so;
- infringe anyone's copyright, trade marks or other rights;
- send spam, unsolicited advertising or chain messages;
- introduce viruses, malware or other harmful code;
- gain or attempt to gain unauthorised access to FamFusion, other people's accounts or Families, or our systems, or probe, scan or test their vulnerability without our written permission;
- overload, disrupt or interfere with FamFusion, including by denial-of-service attacks or by excessive automated requests;
- collect information about users, or scrape or extract content, except as allowed in Using our content.
If you believe you have found a security vulnerability, please tell us at the address above rather than exploiting it. We welcome responsible disclosure.
Accounts (if and when offered)
- Individual accounts. Each person has their own account and their own sign-in details. Accounts and passwords must not be shared, including within a Family. A person can belong to more than one Family using the same account.
- Accurate information. You must give accurate, up-to-date information when you register and keep it up to date.
- Security. You are responsible for keeping your sign-in details confidential and for activity on your account that happens because you did not take reasonable care of them. Tell us straight away if you think someone else has accessed your account.
- Our security measures. We may require security steps (such as email verification or stronger authentication) and may temporarily restrict an account if we reasonably suspect unauthorised access.
- Closing your account. You will be able to close your account at any time. Closing an account ends these Terms for the account-based services, subject to what happens to content and any paid-service terms.
- Unauthorised use. We are not responsible for loss caused by someone using your account because you shared your sign-in details or did not keep them safe, except where the loss results from our own failure to take reasonable care.
Families, memberships and roles (if and when offered)
- Families and memberships. A Family is a shared private space. People join a Family through a membership. Your role and permissions belong to each membership, so you may have different roles in different Families. Where you belong to more than one Family, FamFusion shows you one Family at a time (your active Family), and content is visible only within the Family it belongs to unless you deliberately share it.
- Roles and permissions. Families may have roles such as owner, adult administrator, adult member and extended family member. What each role can see and do depends on the product's configuration and the settings chosen by the Family's administrators. We will explain roles in the product.
- Responsibilities of Family administrators. People who manage a Family must act reasonably and in good faith towards its members, only invite people they know and who belong there, and use administrative powers (such as removing members) fairly.
- Invitations. Invitations are personal, expire and can be used once. Only invite people with their agreement, and only send an invitation to the person it is meant for.
- Leaving or being removed. You can leave a Family. Administrators may remove members. When you leave or are removed, you lose access to that Family's private space. What then happens to content you contributed, and to content others shared with you, will be set out in the product's rules before Family content is available, and explained to you before you leave.
- Extended family and connections between Families. If we offer extended-family relationships or connections between Families, they will be opt-in, controlled by the responsible adults and limited to what each Family chooses to share. FamFusion is not a place to seek contact with strangers.
- Disagreements within a Family. Family relationships change. We cannot decide family disputes, including after separation. We will apply the Family's roles and settings and our published rules, and may take reasonable steps to protect people's safety and privacy.
Children
Today FamFusion is written for adults. Children may enjoy reading articles with a parent or carer, but they do not need to, and cannot, create an account.
FamFusion is intended to become a place where whole families, including children, can take part. If and when we offer this:
- children will only take part through a Family managed by responsible adults, with the involvement or authorisation of a parent or someone with parental responsibility where the law requires it;
- features, settings and information will be designed to be appropriate for the child's age, with high-privacy settings by default, in line with UK data protection law and the ICO's Age Appropriate Design Code;
- children's information will be visible only within their Family and the audiences their responsible adults have allowed, and children will not be discoverable by, or able to be contacted by, people outside those audiences;
- some features may be available only above certain ages, or only to adults;
- responsible adults must supervise children's use appropriately and must not add a child to a Family, or share content about a child, without the authority to do so;
- we will publish specific rules for child participation, including any minimum ages and how parental authorisation works, before it launches.
If you have a concern about a child's safety on FamFusion, contact us immediately. Where a child is in immediate danger, contact the emergency services on 999.
Your content (if and when offered)
"Your content" means anything you add to FamFusion, such as posts, comments, questions, ideas, memories, stories, plans, photographs and other files.
- Your rights in your content. We do not claim ownership of your content, including your family memories and photographs. Any intellectual property rights you have in it stay with you.
- Ownership is not the same as access. Family content is often created, shared and kept together. Owning rights in a piece of content does not by itself decide who in a Family may continue to see it, or whether it is kept, exported or deleted when someone leaves a Family, is removed, deletes their account, or when a Family relationship changes. Those rules will be set out in the product, and in these Terms where needed, before Family content is available.
- The permission you give us. So that we can run FamFusion, you give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, process, adapt the format of (for example resizing images) and display your content, only as needed to provide, secure and improve FamFusion for you and the people you share it with, according to the visibility settings and Family rules that apply. The licence ends when your content is deleted from FamFusion, except for backup copies kept for a limited period, copies we must keep by law, and content that remains available to others under those published Family rules. We will not use your private Family content in our marketing or make it public without your separate permission.
- Your responsibility for what you share. You must have the right to share your content and must not share anyone else's personal information, photographs or private matters without an appropriate basis, such as their permission, or the permission of a parent or carer for a child.
- Visibility. Content is visible to the audiences you and your Family's settings allow. Think carefully before sharing: people who can see content may be able to copy it outside FamFusion.
- Rules for content. Content must follow Acceptable use.
- Moderation and removal. We are not obliged to review content before it is shared, but we may review, restrict or remove content, and suspend accounts, where we reasonably believe the content breaks these Terms or the law or puts someone at risk, or where the law requires. Where appropriate we will tell you and explain how to ask us to reconsider.
- Keeping copies. We take reasonable steps to keep your content safe and backed up, but FamFusion is not a guaranteed archive. Please keep your own copies of anything irreplaceable. We will give you a way to download your content before we remove it at the end of a service, where reasonably possible.
- Reporting content and intellectual property complaints. If you think content on FamFusion infringes your rights or is harmful, contact us with details of the content, where it is and why. We will review reports promptly and act on them where appropriate.
Paid services, subscriptions and trials (if and when offered)
Before you buy
- We will clearly show the total price, including VAT where it applies, what is included, how often you will be charged, how long any commitment lasts, whether and when the plan renews automatically, and how to cancel, before you are asked to pay.
- Any storage limits or other limits of a plan will be stated.
- Your contract starts when we confirm your purchase. We will send you a confirmation, including these Terms and the specific terms, on a durable medium such as email.
Payment and renewal
- Payments will be processed by a payment provider we name at checkout. We will not store your full card details.
- If you buy a subscription, you authorise us to charge the price for each billing period until you cancel. Before a free or discounted trial ends, and before a long subscription renews, we will send you a reminder that explains what will happen and how to cancel, as the law requires.
- If a payment fails, we will tell you and give you a reasonable opportunity to update your payment details before we pause or end paid features. We will not charge fees for a failed payment beyond what the law allows.
Trials and promotional prices
- Any free or discounted trial will state how long it lasts, what happens when it ends, the price that will apply afterwards and how to cancel before being charged.
- Promotional prices will state how long they last and the price that applies afterwards. We may limit trials and offers to one per person or Family.
Changes to price and plans
- We will not change the price of a fixed-term commitment during that term. For a rolling subscription, we will give you reasonable advance notice (at least 30 days) of any price increase, and you may cancel before it takes effect without paying the new price.
- You may upgrade or downgrade where we offer that. We will explain how charges are adjusted before you confirm.
- We will not remove or reduce a paid feature in a way that significantly disadvantages you during a period you have paid for, unless it is necessary for legal, security or reasons outside our control. If we do, we will tell you and you may cancel and receive a refund for the part you have paid for and not received.
Cancelling
- Cancelling is straightforward. If you signed up online, you will be able to cancel online, simply and without unnecessary steps. You will not have to speak to anyone to cancel. You can also cancel by emailing us.
- Cooling-off period. As a consumer buying online, you normally have 14 days after the contract is made to cancel for any reason. If you ask us to start a digital service within that period, you will pay for what you received before cancelling, calculated in proportion to the whole. If you buy digital content and expressly agree that we supply it immediately and acknowledge that you lose the right to cancel, the right to cancel ends when supply begins. We will explain exactly which rule applies at checkout.
- Cancelling later. You can stop a subscription from renewing at any time. Unless the specific terms say otherwise, paid features continue until the end of the period you have paid for. Where the law gives you a further right to cancel (for example after a trial converts or a longer subscription renews), we will honour it.
- Refunds. Refunds due under a cooling-off right, or because we have not provided what we promised, will be paid without undue delay and within 14 days, to the original payment method. Otherwise, payments for periods that have started are not refundable unless the specific terms, or the law, say so.
If something goes wrong
Digital content and services we sell must be as described, of satisfactory quality and fit for purpose, and services must be provided with reasonable care and skill. If they are not, you have rights to a repair, replacement, repeat performance or price reduction or refund, as the law provides. If faulty digital content we supply damages your device or other digital content, and we failed to use reasonable care and skill, we will repair the damage or compensate you.
After a paid plan ends
When a paid plan ends, the paid features stop. We will not delete your content just because a paid plan ends without first telling you what will happen, giving you a reasonable period to download it or move to a plan that suits it, and explaining any storage limits of the free service.
Competitions and promotions
If we run a competition, prize draw, giveaway or other promotion, it will have its own rules explaining who can enter, how, closing dates, prizes and how winners are chosen and contacted. Those rules apply alongside these Terms and prevail if they conflict. Promotions will not be offered to children unless the rules say so.
Other websites and services
FamFusion links to other websites, such as research we cite. We include links for information; we do not control those websites and are not responsible for their content, availability or privacy practices. A link is not an endorsement.
If we later work with carefully selected partners, or let you use third-party services through FamFusion, we will make clear when you are dealing with a third party and whose terms apply. Affiliate links, advertising and sponsored content are covered in Affiliate links and advertising.
Affiliate links and advertising
FamFusion is free to read. To help pay for it, some articles may include affiliate links: links to products or services sold by retailers such as Amazon. If you buy through an affiliate link, we may earn a commission from the retailer. You pay the same price whether or not you use our link.
Amazon. As an Amazon Associate I earn from qualifying purchases.
- How you will know. An article that contains affiliate links says so clearly at the start, before you reach the links, and each affiliate link is labelled as one. Affiliate links open the retailer's website and do not hide where they lead.
- Our independence. We decide what to write about and what to suggest ourselves. Commission never decides what we recommend; we only link to things we would suggest anyway, and we may suggest things we earn nothing from. We do not accept payment for favourable coverage, and we never publish fake reviews or reviews written in exchange for payment or free products.
- Buying from a retailer. We do not sell the products we link to. If you buy something, your contract is with the retailer, on the retailer's terms. The retailer is responsible for the product, its price, delivery and returns, and your consumer rights for the purchase are against the seller. Prices and availability are set by the retailer and can change at any time; we do not show prices unless they come directly from the retailer's own product information and say when they may have changed.
- Sponsored content and gifts. If a company pays us, or gives us a product or service, in return for coverage, we will label that content clearly as advertising (for example "Ad" or "Paid partnership") at the start, and name the company.
- Display advertising. FamFusion does not currently show display adverts. If we introduce them, they will be clearly distinguishable from our own content, and we will not use advertising cookies or tracking on your device unless you have agreed to it first (see our Cookie Policy). We will not show adverts based on profiling to children.
- Advertisers and retailers. We are not responsible for advertisers' or retailers' products, services, websites or claims. This does not affect our responsibility for our own content, described in Our responsibility to you.
What happens to information when you follow an affiliate link is explained in our Privacy Policy and Cookie Policy.
Feedback
We welcome feedback and suggestions. If you send us ideas for improving FamFusion, we may use them without owing you payment, but we will not publish your name or personal details with them without your permission.
Availability and changes to FamFusion
We aim to keep FamFusion available and working well, but free services are provided as they are and we cannot promise they will always be available or free from errors. We may need to suspend FamFusion, or parts of it, for maintenance, updates, security reasons or events outside our control, and will try to keep interruptions short.
FamFusion will evolve. We may add, change or remove free content and features, for example to improve them, respond to feedback, or meet legal or security requirements. If we plan to close a service that holds your content, we will give you reasonable notice and a way to download your content where reasonably possible.
For paid services, changes are subject to the protections in Paid services, and we will not make changes that significantly reduce what you have paid for except as set out there.
Suspension and termination
You can stop using FamFusion at any time.
We may suspend or end your access to FamFusion, or to an account, Family or feature, if we reasonably believe that you have seriously or repeatedly broken these Terms, that your use puts other people (especially children), FamFusion or our systems at risk, or that we must do so by law. Where appropriate and lawful, we will tell you why and give you an opportunity to put things right or respond. In urgent cases (for example, to protect someone's safety or the security of FamFusion) we may act first and explain afterwards.
If we end a paid service because of your serious breach, we may keep payment for the period already used but will refund any amount paid for a period after the service ends, unless the law allows otherwise. If we end a paid service for any other reason, we will refund payments for the period not received.
Sections that by their nature should continue after these Terms end (such as those about intellectual property, liability and disputes) will continue.
Our responsibility to you
If you are a consumer
- If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failure to use reasonable care and skill. Loss is foreseeable if it is obvious it will happen or if, when the contract was made, both we and you knew it might happen.
- We are not responsible for loss that is not foreseeable, loss caused by events outside our control, or loss caused by you (for example by not following safety guidance or ignoring an obvious risk).
- FamFusion is for domestic and private use. We are not liable to consumers for loss of profit, loss of business, business interruption or loss of business opportunity.
- For free services, our responsibility is limited to what is reasonable given that you have not paid for them; this does not affect the liabilities listed below.
Liability we never exclude
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a consumer (including under the Consumer Rights Act 2015), or for anything else that cannot lawfully be excluded or limited.
If you use FamFusion for business
FamFusion is intended for personal and domestic use. If you nevertheless use it in the course of a business, then, subject to Liability we never exclude, we are not liable to you for any loss of profit, sales, business, revenue or business opportunity, loss of goodwill or reputation, or any indirect or consequential loss.
Changes to these Terms
We may update these Terms, for example to reflect changes to FamFusion, new features, or changes in the law. The version and date at the top of this page show which version is current, and the version history summarises changes.
If you have an account, we will tell you about material changes in advance, normally at least 30 days before they take effect unless they are required sooner by law or for security. If you do not agree, you may close your account (and cancel any subscription) before the changes take effect. Changes will not apply to a paid period that has already started if they would significantly disadvantage you, unless the law requires them.
If you only use the public website, the version published when you use it applies.
Complaints and disputes
If you have a complaint, please contact us first at info@q25.co.uk. We will try to resolve it quickly and fairly.
These Terms are governed by the law of England and Wales. You and we may bring proceedings in the courts of England and Wales. If you live in Scotland, you may also bring proceedings in Scotland; if you live in Northern Ireland, you may also bring proceedings in Northern Ireland. If you are a consumer living elsewhere in the UK, you also keep the benefit of any mandatory consumer protections of the place where you live.
General
- Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control (such as failures of hosting or internet infrastructure, cyber-attacks despite reasonable precautions, extreme weather or industrial action). We will tell you where possible and take reasonable steps to minimise the effect. If a paid service is significantly affected for a long time, you may cancel and receive a refund for the part not provided.
- Transferring this agreement. We may transfer our rights and obligations under these Terms to another organisation, for example if FamFusion is sold or reorganised. We will make sure the transfer does not reduce your rights, and if you have a paid service you may cancel and receive a refund for any period not provided if you are unhappy with the transfer. You may transfer your rights only with our written agreement.
- No third-party rights. This contract is between you and us. No one else has any right to enforce its terms under the Contracts (Rights of Third Parties) Act 1999.
- Separate provisions. Each section of these Terms operates separately. If a court decides that any part is unlawful or unenforceable, the rest remains in effect.
- Delay in enforcing. If we do not insist straight away that you do something you are required to do, or delay taking action, that does not mean we cannot do so later.
- Our agreement. These Terms, together with any specific terms we show you for a particular service or promotion, are the agreement between you and us about FamFusion. This does not affect anything we have told you that the law treats as part of the contract.
